Welcome to Etched Laser Works ("ELW," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of etchedlaserworks.com (the "Site") and any purchase you make through it. By placing an order, creating an account, or otherwise using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Etched Laser Works, an Oregon limited liability company operating out of Hermiston, Oregon.

1. Who We Are

ELW specializes in true 3D internal laser engraving inside K9 optical crystal, along with metal scripture cards, metal business cards, and leather goods. Every custom crystal piece is produced using a proprietary internal engraving process — not surface etching — and is individually made to order.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on this Site. By using the Site, you represent that you meet this requirement.

3. Custom Orders & the Proof-Approval Process

Most ELW products are made-to-order and personalized based on information, photos, or files you provide.

Accuracy of Submitted Materials. You are responsible for the accuracy of names, dates, spelling, images, and any other content you submit.
Turnaround Time. Estimated production time begins after order placement. Production turnaround is 5 business days; these timeframes are estimates, not guarantees, and may extend during high-volume or holiday periods.
Image/File Quality. Low-resolution or poor-quality submitted images may affect final engraving clarity. We will flag known quality issues prior to production where reasonably possible, but final responsibility for source material rests with the customer.

4. Pricing & Payment

All prices are listed in U.S. dollars and are subject to change without notice until an order is placed.
Payment is due in full at the time of order unless otherwise agreed in writing for approved B2B or wholesale accounts.
We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or an inability to verify the order.

5. Final Sale / Custom Goods

Because ELW products are personalized and made to order, all sales of custom/personalized items are final and not eligible for return or refund due to buyer's remorse, changed preferences, or ordering mistakes not caught prior to proof approval.

This final-sale policy does not limit your rights regarding:

Items that arrive damaged in transit,
Manufacturing defects

6. Shipping

Shipping timeframes, carriers, and risk-of-loss terms are detailed in our separate Shipping Policy. Estimated delivery dates are not guaranteed. Title and risk of loss pass to you upon our delivery to the shipping carrier, except where a claim for carrier damage is properly filed per our Returns & Refunds Policy.

7. Intellectual Property

All Site content — including photography, product designs, layout, copy, and branding — is the property of Etched Laser Works and may not be copied, reproduced, or used without written permission.
Customer-Submitted Content. By submitting photos, logos, text, or other materials for engraving, you represent that you own the rights to that content or have permission to use it, and you grant ELW a limited license to reproduce it solely for the purpose of fulfilling your order.
You agree not to submit content that infringes on the intellectual property, trademark, or publicity rights of any third party. ELW reserves the right to refuse any order containing content it believes may infringe such rights.

8. Limitation of Liability

To the fullest extent permitted by law, Etched Laser Works and its owner/operator shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Site or products purchased through it, including but not limited to loss of sentimental value, delay damages, or third-party claims. Our total liability for any claim related to a product or order is limited to the amount you paid for that specific order.

Nothing in these Terms is intended to limit liability where such limitation is not permitted under applicable Oregon or federal law.

9. Warranty Disclaimer

Products are provided "as is." Except as expressly stated in our Returns & Refunds Policy, ELW makes no other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose, to the extent permitted by law.

10. Account Registration (if applicable)

If the Site allows account creation, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

11. Prohibited Uses

You agree not to use the Site to:

Submit unlawful, harassing, defamatory, or infringing content for engraving;
Attempt to interfere with the security or normal operation of the Site;
Use automated means (bots, scrapers) to access the Site without our written permission;
Misrepresent your identity or affiliation.

12. Third-Party Services

The Site may use third-party platforms (e.g., Shopify, payment processors, shipping carriers) to operate. Your use of those services may also be subject to their own terms and privacy policies.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Oregon, and you consent to personal jurisdiction there.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The "Last Updated" date above reflects the most recent revision.
